Q 424: A company imported certain compo-nents under payment of duty. These were found to be defective and the overseas supplier is willing to take them back. Please advise how the company can re-turn the components to the supplier? What will hap-pen to the duty paid at the time of import?

d) However, the date of export invoice will be currentdate.
e) The country of origin will be that of overseas.
f) Net weight, gross weight should match the import in-voice.g) While preparing export invoice/Customs invoice, a cross reference of import invoice should be mentioned for ease of the transaction.h) The term of payment is to be decided as per the actual commercial situation.i) If no payment is going to be received, then it should be mentioned in the invoice accordingly. 5. Shipping Bill will be prepared by your Custom Bro-ker based on your invoice. To claim refund of import duty paid earlier, he will mention Section 74 of the Customs Act, 1962.
6. Your Custom Broker will require uploading import related documents for Customs to process your claim of refund of import duty.
7. There will not be a Certificate of Origin. However, based on COO at the time of import, you can obtain a new COO indicating country of origin which is actual. This document is not essential.
8. Export value declaration form is also to be submitted and proper declaration is to be provided.
9. Importer will also require complying with the provi-sion of FEMA.
10. Entries in EDPMS and IDPMS are also required to be knocked off.
